11. Text and Data Mining, Scraping and Automated Access

You may link to our homepage provided that you do so in a way that:

  • is fair and lawful;

You must not submit a fake or misleading review or arrange for another person to do so.

You retain ownership of content that you submit. However, by submitting content for publication, you grant us a non-exclusive, royalty-free licence to:

  • host;
  • store;

  • use

that content for the purposes of operating, improving and promoting our website and business.

  • measurements and sizing information may be approximate;
  • manufacturer information may change; and
  • errors may occasionally occur.

Product images are for illustrative purposes, although we aim to represent each product fairly and accurately.

Nothing in these terms excludes our responsibility to supply products that comply with your statutory rights, including the requirement for goods to be as described, of satisfactory quality and fit for any particular purpose made known to us where the law applies.

15. Product Availability

All products are subject to availability.

Adding a product to your basket does not reserve that product or guarantee that it will remain available.

We may remove a product from sale or limit the number of products that may be purchased by one customer where reasonably necessary to:

  • manage limited stock;
  • prevent fraud;
  • prevent misuse of promotions;
  • ensure fair access to products; or

Any restrictions applying to a particular product will be displayed on the relevant product page where reasonably practical.

16. Terms of Sale

These Terms of Sale apply when you buy a product from our website.

Placing an Order

Your order is an offer to buy a product from us. After you place an order, we will send you an email acknowledging that we have received it. This is not acceptance of your order. A contract between you and us is formed when we dispatch your products and send you a dispatch confirmation.

If we are unable to supply a product, we will tell you as soon as possible and refund any payment you have made for it.

Prices and Payment

Prices are shown in pounds sterling. Where VAT applies, it is included in the displayed price. Delivery charges are set out in our Shipping & Delivery Policy and shown at checkout before you pay.

Payment is taken at checkout through our payment providers. We may cancel an order and refund you if payment is not received or cannot be verified.

We take reasonable care to price products correctly. If we discover an obvious pricing error before dispatch, we will contact you and give you the option to confirm the order at the correct price or cancel it and receive a full refund.

Delivery

We deliver to addresses in the United Kingdom and the Republic of Ireland. Dispatch and delivery details are set out in our Shipping & Delivery Policy. Risk in the products passes to you when they are delivered to the delivery address you gave us.

Cancellation, Returns and Refunds

Our Returns & Refund Policy explains how to cancel an order and return products. If you are a consumer, you also have a statutory right to cancel your order within 14 days of delivery.

Faulty or Incorrect Products

Products must be as described, of satisfactory quality and fit for purpose. If a product is faulty, damaged or not as described, please contact us as soon as possible. Your statutory rights under the Consumer Rights Act 2015 apply, and our Returns & Refund Policy explains how we will deal with the issue.

Our Responsibility for Products

Our responsibility for loss or damage connected with the products we sell is set out in section 21. Nothing in these Terms of Sale affects your statutory consumer rights.

17. Independent Reseller Status

ACTIVEFITUK LTD is an independent retailer and reseller.

Unless expressly stated otherwise, we are not affiliated with, endorsed by, sponsored by or officially connected with the brands whose products appear on our website.

References to brand names, product names and trade marks are used to identify and describe the genuine products being offered for sale.

All third-party trade marks remain the property of their respective owners.

18. Information on Our Website

Content published on our website is provided for general information and to help customers understand our products and services.

It is not intended to amount to professional or specialist advice.

Although we make reasonable efforts to keep website content accurate and current, we do not guarantee that all general information will always be complete, accurate or up to date.

19. Third-Party Websites and Services

Our website may contain links to websites, social-media platforms, payment services or other resources operated by third parties.

  • its content;
  • its operator;
  • its products; or
  • its services.

We do not control third-party websites and are not responsible for their content, availability, security or privacy practices.

You should review the applicable terms and privacy policies before using a third-party website or service.

  • any other liability that cannot legally be excluded or limited.

If You Are a Consumer

A consumer is an individual using the website wholly or mainly for purposes outside their trade, business, craft or profession.

Nothing in these terms affects your statutory consumer rights.

We are responsible for loss or damage that you suffer where it is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

Loss or damage is foreseeable if it was obvious that it would happen or if both you and we knew that it might happen when you accepted these terms.

We are not responsible for:

  • loss that was not foreseeable;
  • business losses suffered by a consumer;
  • loss caused by your failure to follow reasonable instructions;
  • loss caused by inaccurate information provided by you; or
  • matters outside our reasonable control.

If You Are a Business User

If you use our website for purposes relating to your trade, business, craft or profession:

  • we exclude all implied conditions, warranties, representations and other terms that may apply to the website or its content to the fullest extent permitted by law;
  • we will not be liable for loss arising from your use of, inability to use or reliance on the website or its content, except where liability cannot legally be excluded; and

  • loss of profit;
  • loss of sales or revenue;
  • loss of business;
  • business interruption;
  • loss of anticipated savings;
  • loss of opportunity;
  • loss of goodwill; or
  • loss of reputation.

Nothing in this section excludes liability where it would be unlawful to do so.

The Cookies and Similar Technologies section of our Privacy Policy provides further information about cookies and similar technologies used on our website.

  • your activity creates a security risk;
  • your activity is fraudulent or unlawful;
  • your activity may harm another person;
  • suspension is required by law; or
  • suspension is necessary to protect our website, business or customers.

Where appropriate and lawful, we will try to explain the reason for the action taken.

Termination of access does not affect any rights or liabilities that arose before termination.

24. Transfer of Our Rights and Obligations

We may transfer our rights and obligations under these terms to another organisation, for example in connection with a sale or restructuring of our business.

We will ensure that any transfer does not reduce your legal rights.

You may not transfer your rights or obligations under these terms to another person without our written agreement, except where applicable law gives you the right to do so.

25. If Part of These Terms Is Invalid

If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

The unlawful or unenforceable provision will be treated as modified to the minimum extent necessary to make it valid and enforceable, where the law permits this.

26. Delay in Enforcing These Terms

If we do not immediately enforce a right under these terms, this does not mean that we have waived that right.

If we waive a breach on one occasion, this does not mean that we will waive a later breach.
